Can my husband prevent me from moving out of state with our son if we were to divorce?

Hi. I have a son & I am married to my son’s father. If I were to receive a job relocation to another state & my husband did not want to go resulting in a divorce, can he prevent me from leaving the state since I would leave with OUR son? Husband has other children & wouldn’t want to leave them behind is reason why. Thank you for your responses.

Yes, it is possible.

yes he can – my mom cannot even leave the school district she’s in!
also – you’re willing to consider divorce over a job!?!?!
A divorce/custody is based on what is best for both of you and your son. It will be determined during the litigation period and they are not nice people. Be careful with these people. The more negatives you say about your spouse the more they come after you. I know! I went through this once!
The courts generally frown on you doing that….
But….despite that….unless he is doing harmful things to his child, I think it is selfish of you to contemplate doing so. Divorce is hard enough on a child without geographically distancing the parent and child as well. BOTH parents are important to a child’s proper development.
Why further punish the child for the mistakes of the adults? Would you really put career goals ahead of the well-being of your child?

Probably, but that is a real legal question for a lawyer, my opinion wouldn’t stand up in court. Call legal aid.

i don’t think so because my husband has an ex wife who did that very thing. She relocated because of her job and moved to Oregon with his son.It was very hard on my husband.

It varies from state to state.
If you have joint custody, your husband has his rights too.
Yes he can prevent you from leaving, and unless he is a bad person you shouldn’t take your son away from him. Children need their fathers and mothers both.
